TERMS AND CONDITIONS

The ‘Buy a Bose Smart Speaker, activate Alexa, and stand a chance to win QC35 II daily contest’ (“Contest”) is sponsored by Bose Corporation India Private Limited (collectively “Bose”).

Any person buying a Bose product with Alexa during the Contest period is eligible to participate in the Contest. The Bose product(s) with Amazon Alexa enabled (Bose Home Speaker 500, Bose Soundbar 500, Bose Soundbar 700) are available at all Bose retail stores, Multi-brand stores, and all authorized resellers of Bose India including at www.amazon.in and its corresponding mobile site and mobile application (collectively, “Amazon.in”).

Please read these terms and conditions (“Terms and Conditions”) before entering the Contest. You agree that, by participating in this Contest, you will be bound by these Terms and Conditions in relation to this Contest and/or Prize (as defined hereinafter).

These Terms and Conditions are in addition to the Amazon.in Conditions of Use & Sale and Privacy Notice to which you agree to by using Amazon.in (defined hereinafter). To the extent the Conditions of Use & Sale are inconsistent with these Terms and Conditions; these Terms and Conditions will prevail with respect to the Contest only.

For the purposes of these Terms and Conditions, wherever the context so requires, “you” or “your” shall mean any natural person who is a participant in the Contest.

This Contest is available in all the States and Union Territories across India except in the state of Tamil Nadu in view of the provisions of the Tamil Nadu Prize Scheme (Prohibition) Act, 1979.

The employees of Bose and Amazon Seller Services Private Limited (“Amazon”) are not eligible to participate in this Contest.

1. Details of contest and how to enter

a. The Contest commences on February 1, 2019 and is valid till February 28, 2019 (the “Contest Period”).

b. In order to participate in the Contest, you must purchase any Alexa-enabled Bose product during the Contest Period and complete the following steps:

Download the “Bose Music” mobile application > Create a Bose id > Go to Voice Assistants > Select Alexa > Log in to your Amazon.in account or create new Amazon.in account > Select your language as English (IN) > Speak to and activate Alexa > Go to https://www.amazon.in/l/16215559031 > Correctly answer the qualifying question(s).

c. You must use the same Amazon.in account to answer aforesaid qualifying question(s), which you will use to speak to and active Alexa.

d. Last date to register for Alexa to be eligible for the Contest is March 20, 2019 (“Participation Period”).

e. If you complete each step provided in paragraph 1 (b) above, within the given time period, you will stand a chance to win the Prize(s) (defined hereinafter) under the Contest. Entries received after the expiry of the Participation Period will not be entertained and will be considered ineligible for the Contest.

2. Prize and winners

a. Amongst the participants who answer the qualifying question(s) correctly, 28 (twenty-eight) winners (one each day during the contest period) will be selected by Bose by draw of lots to be eligible to receive Bose QC35 II headphones each (each a “Prize”). The winners will have to follow the process below in order to claim the Prize.

b. Each winner will receive a unique code (“Code”) by 1st April, 2019 in the email address registered with Amazon.in. The Code can be redeemed by the winner to purchase the Prize from the specified seller viz. Appario Retail Private Ltd on Amazon.in. The Code should be applied by the winner during checkout on Amazon.in to be able to place an order for the Prize without requiring to pay any consideration.

c. Winner’s name and email should be the one the customer used to register Alexa and answer the question(s). The winner will be contacted via the same email.

d. Each winner will be eligible to receive only one (1) Prize under this Contest, irrespective of the number of Bose devices purchased during the Contest Period.

e. Each Prize will be awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, expressed or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). Any graphics of the Prize, as depicted in any communication regarding the Contest, are for representation purposes only. The actual Prize may differ, including colour and appearance. There are no cash or other prize alternatives available in whole or in part. Prizes are non-transferable, non-refundable, non-assignable, or non-exchangeable. However, in circumstances beyond control, Bose may substitute a similar alternative prize of equal or greater value in its sole discretion.

f. Only the winner, and no other person or agent, may claim the Prize.

3. Miscellaneous

a. You agree that all decisions of Bose and its representatives relating to the Contest will be final and binding. No appeals will be entertained in this regard.

b. You agree that you will not post or transmit any unlawful, defamatory, obscene, offensive, or scandalous material, foul language, or any material that constitutes or encourages conduct that would be considered a criminal offence, likely to give rise to civil liability, or otherwise violates any law. Bose will fully cooperate with any law enforcement authorities or court order lawfully requesting or directing Bose to disclose the identity of anyone posting any such information or materials.

c. By participating in the Contest, you give an explicit consent to Bose and Amazon to contact you at present and in the future for any communication related to Bose or Amazon’s products, special offers, events, and other consumer engagements.

d. Any taxes which may arise out of the winnings from this Contest, and payable in accordance with the laws, rules, and regulations of Central/State government or local authorities, will be borne by individual winner(s). You will not hold Bose or Amazon responsible for payment of the same and/or any dispute arising in relation thereof.

e. This Contest is subject to force majeure circumstances including without limitation, floods, natural disasters, war, act of terror, political unrests, technical snags, act of God, or any circumstance beyond the reasonable control of Bose or Amazon (“Force Majeure Event”). Bose, Amazon and their affiliates will be not be liable for any delay or adverse effect caused to the participants in the Contest including the winners as a result of a Force Majeure Event.

4. Additional terms

a. Amazon may, to the maximum extent permitted by applicable law and in its sole discretion, remove the Contest from Amazon.in at any time, without notice and liability; should viruses, worms, bugs, unauthorized human intervention, or other causes beyond Amazon’s control, corrupt or impair the administration, security, fairness, or proper play of the Contest or submission of entries.

b. Amazon, Bose, and their affiliates are not responsible for: (i) lost, misdirected, late, incomplete, or unintelligible entries or for inaccurate entry information, whether caused by you or by any of the equipment or programming associated with or utilized in the Contest, or by any technical or human error that may occur in the processing of entries; (ii) any printing or typographical errors in any materials associated with the Contest; (iii) any error in the operation or transmission, theft, destruction, unauthorized access to, or alteration of, entries, or for technical, network, telephone, computer, hardware or software, malfunctions of any kind, or inaccurate transmission of, or failure to receive any entry information on account of technical problems or traffic congestion on the Internet or at any website; or (iv) injury or damage to your or any other computer or mobile resulting from downloading any materials in connection with the Contest.

c. Bose or Amazon (as the case may be) may, in its sole discretion, disqualify any individual found to be: (a) tampering with the entry process or the operation of the Contest or Amazon.in; (ii) acting in violation of these Terms and Conditions; or (iii) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person.

d. If your entry is incomplete or if you use robotic, automatic, programmed, or similar entry methods, your entry will be void. The authorized subscriber of the email account used to enter the Contest at the actual time of entry will be deemed to be the participant and must comply with these Terms and Conditions in the event of a dispute as to entries submitted by multiple users having the same email account. The authorized account subscriber is the natural person who is assigned an email address by an internet access provider, online service provider, or other organization responsible for assigning email addresses for the domains associated with the submitted email addresses. No benefits greater than those described in the “Prize and Winners” section above in these Terms and Conditions will be awarded.

5. Publicity release

a. By entering into the Contest, you give Bose, Amazon, and their affiliates permission to use your name, likeness, image, voice, and/or appearance as such may be embodied in any pictures, photos, video recordings, audiotapes, digital images, and the like, taken or made in relation to the Contest and any promotions, events, or contests to follow. You agree that Bose, Amazon, and their affiliates have the right to exhibit/publish the above materials in any and all media now existing or hereinafter created, including without limitation internet, television, film, videotapes, radio, and print media, without any compensation whatsoever for advertising and publicity purposes. You hereby release Amazon, Bose, and/or their affiliates and its agents and assigns from any and all claims which arise out of or are in any way connected with such use.

b. You consent to Amazon, Bose, and their affiliates the right to use your name, voice or picture, or the content of their Contest entry to promote the Contest and any promotions, events, or contests to follow.

6. Liability release

a. By participating in the Contest, you will be legally bound hereby, to release from liability, and hold harmless Amazon, Bose, and any of their respective employees or agents representing or related to Amazon and its services/products for any matters in relation to this Contest, including the Prize and/or benefits. This release is for any and all liability for personal injuries (including death), property loss or damage, and misuse of the benefits/ Prizes offered under this Contest, in connection with any activity, directly or indirectly, by reason of the acceptance, possession, or participation in the Contest, even if caused or contributed to by Amazon’s or Bose’s negligence.

b. Under no circumstance will Bose or Amazon and their respective directors, employees, officers, affiliates, or subsidiaries, be liable to you and/or any third party for any lost profits or lost opportunity, indirect, special, consequential, incidental, or punitive damages whatsoever.

c. You specifically agree not to file in person/through any family member and/or any third party any applications, criminal and/or civil proceedings in any courts or forum in India against Bose, Amazon, and their respective directors, employees, officers, affiliates, or subsidiaries to claim any damages or relief arising out of or relating to the Contest.

7. Alteration of Terms and Conditions

a. Bose reserves the right, in its sole and absolute discretion, to change the Terms and Conditions and to alter/vary or terminate the Contest at any time without any prior notice in compliance with any law, ruling, order, regulation, requirement, or instruction of any Central/State Government or for any other unavoidable reason beyond its control. Bose will inform you of such discontinuance/cancellation as soon as possible, and Bose and Amazon will not be liable for any loss or damages which may arise due to such discontinuation or termination.

8. Marks

a. The Bluetooth® word mark is a registered trademark owned by Bluetooth SIG, Inc. and any use of such mark by Bose is under license.

b. Alexa and accompanying materials are © 2019 by Amazon or its affiliates.

9. Governing law and jurisdiction

a. These Terms and Conditions will be governed by and construed in accordance with the applicable laws in India. All matters with respect to the Contest are subject to the exclusive jurisdiction of the courts at Haryana.
